reading and understanding a Supreme Court case.
This assignment will acquaint you with reading and understanding a Supreme Court case. The case is about a business making real business decisions about how it wished to provide employee health care benefits, in opposition to a government mandate of certain types of benefits. The company, Hobby Lobby Stores, Inc., took a stand in opposition to the government’s position, based on ownership’s religious beliefs, raising a Constitutional question under the First Amendment.
Prepare a written Case Brief of the U.S. Supreme Court case Burwell v. Hobby Lobby Stores, Inc., that you are reading for this week’s forum. The opinion is available at: https://www.supremecourt.gov/opinions/13pdf/13-354_olp1.pdf
**The correct case citation to use in your brief is: Burwell v. Hobby Lobby Stores, Inc., 573 U.S. 682 (2014).
- Download and read: How to Brief a Case — Please follow this to prepare this Assignment. Include a title cover page. You do not need a reference page. (See template.)
- Download, save, and open to use for Assignment: Word Template. This is the form for this Assignment. Please use it.
- A Sample Case Brief of another Supreme Court case is attached to give you an example.
Write this in your own words! Submit your paper, using the Word Template, as a Word document attachment to this Assignment by the due date. Your paper will go through TurnItIn (TII) automatically on submission. If you receive a high TurnItIn score, you may need to revise and resubmit. I am not concerned about similarity relating to the form of the brief. Similarily, focus is on use of your own words rather than direct quotes from the case or other sources. Review the Turnitin report. You are permitted multiple submissions so that you can self-correct an unsatisfactory TII report and resubmit. I recommend submitting a draft ahead of the due date to test it on TII. The TII report does not have to be perfect but anything in the RED zone must be rewritten!
ASSIGNMENT DUE: Week 2 Sunday, 11:59 pm ET
This Assignment does not have a formal grading rubric. Grading criteria used by your professor will include the following: mechanics (grammar, spelling, etc.) (10%), format (follow the Template) (10%), similarity (use of your own words – Turnitin report) (10%), content (accuracy, completeness and your insight of case holding, reasoning, correctness of brief sections) (70%)
